High redress for slip and fall on pavement

On 9 October 2020, the Regional Court in Strzyżów (I Civil Division) made a ruling in favour of one of our Client. Under the ruling the claimant was awarded the amount of PLN 67.832,13 as compensation for the moral damage and incurred costs, which included the costs of health care provided by the claimant’s relatives during convalescence period. The amount awarded for our Client includes also the statutory interest from the default notice date to the date of the ruling as well as return of attorney fees.

The claimant tripped on an untreated, snow-covered and icy pavement outside a grocery store and fell flat on to the ground. As a result of this accident, she broke her right leg and left arm.

The direct cause of the incident and the resulting injuries was the fact that the path leading to the store was not protected in any way. In particular, the path was not cleared of snow or sprinkled with salt or sand.

The claimant was shocked and shaken by the accident and found the consequences of the fell particularly distressing. For 6 weeks she was in a wheelchair, then for another few weeks she was moving only on crutches. Additionally, during this period she attended rehabilitation.

In the ruling of 9 October 2020, the Court awarded the claimant the amount of PLN 50.000 as redress for moral damage resulting from the accident.
